The application to set aside registration was dismissed: the Malaya proceedings constituted a valid admiralty in rem action (deemed service and solicitors' appearance were effective), the ship was situate in Malaysia during the proceedings so Malayan courts had jurisdiction under s.6(2)(b), enforcement in Hong Kong did not offend public policy, and there was no evidence the Malaya judgment was not executable in Malaysia at the registration date; accordingly the registration order remains valid and enforceable.
