On the balance of probabilities the bank records and signed authorisation established that the defendant was the sole authorised person capable of withdrawing from the account after the deceased's death, the defendant failed to produce evidence to rebut that inference, and therefore the defendant unlawfully withdrew HK$77,962.22; judgment for plaintiff for that sum with interest from 31/5/2007 at HSBC prime rate +1% and costs (subject to assessment).
