Evidence was insufficient to rebut the presumption of equal beneficial ownership; balancing creditors' interests and the respondent's personal and family circumstances (age, unstable income, medical condition and dependent child) the court exercised its discretion under the Partition Ordinance and declined to order sale as it would cause very great hardship and exceptional circumstances existed.
