The trial Judge erred in dismissing the petition because the petitioner’s sworn allegations went unchallenged and the Judge should have either elicited full evidence or allowed counsel to do so; accordingly a decree nisi must be granted, with absolute decree deferred until a different District Judge is satisfied as to satisfactory arrangements for the child.
