The application for leave to appeal is refused because the applicant's grounds do not raise any arguable legal issue, the tribunal correctly found the claims incoherent and frivolous and did not commit a legal error in striking them out, and execution of the possession order lawfully permitted forced entry where necessary.

The Court refused leave to appeal because, although the questions related to the propriety of search warrants under Cap 525, the appellants did not demonstrate reasonable prospects of success on any of the grounds advanced; the Dotcom decision did not assist; and there were no exceptional reasons under the "or otherwise" limb to justify granting leave.

The bailiff legitimately relied on his visual observations (signage and labelled goods), supported by tenancy facts (non‑alienation clause and sales returns), and there was no cogent evidence to displace the prima facie conclusion that the goods were in the Defendant's apparent possession; consequently the distraint warrants were validly executed and the Claimant's application to set them aside failed.
