The Director's entitlement under the covenant is non-proprietary and does not amount to a right in or over the lot; therefore she had no locus to be heard in the compulsory sale proceedings and the Lands Tribunal had no jurisdiction to determine her claim for premium or to admit her valuation evidence — accordingly the Tribunal should not have entertained the Director's submissions and the appeals are dismissed.
