Because section 28(3) of the Small Claims Tribunal Ordinance makes a refusal by the Court of First Instance to grant leave final, the Court of Appeal lacks jurisdiction to entertain an appeal against that refusal; accordingly the Court must withdraw the summons and dismiss the application.
