Because section 28(3) of the Small Claims Tribunal Ordinance makes a refusal by the Court of First Instance to grant leave final, the Court of Appeal lacks jurisdiction to entertain an appeal against that refusal; accordingly the Court must withdraw the summons and dismiss the application.

Leave to apply for judicial review was refused because the Registrar's refusal to accept the notice of motion was lawful given statutory provisions precluding a direct appeal to the CFA after refusal of leave by the Court of Appeal, the Applicant failed to show illegality, ultra vires or Wednesbury unreasonableness, and the Court of Appeal's decision is not subject to judicial review.

The court held that it has jurisdiction to try a Crown servant alleged to have been in control of pecuniary resources disproportionate to official emoluments irrespective of the accused's physical location on the relevant date, and that the evidence then before the court established a prima facie case requiring the accused to answer; further, "disproportionate to" is not to be construed as strictly meaning "in excess of" total official emoluments and the court will not depart from established practice by ruling separately on each particularized item.
