Given the offence's low level of criminality, the appellant's status as a first offender, the exceptional and severe collateral consequences of conviction for a serving police officer, and that the magistrate had not considered imposing a fine though statutory power exists, the appellate court was entitled to set aside two months' imprisonment and substitute a fine of $15,000 with default imprisonment of two months if unpaid within ten days.
