On the balance of probabilities the court accepted the plaintiff’s expert evidence (microwave tomography, moisture pattern, crystal formation and fluorescence observations corroborated by Joint Office inspections) that the seepage originated from the defendant’s bathroom in 36D; consequently the defendant was liable in contract and tort and a mandatory injunction and damages were ordered.
