Plaintiffs failed to prove on the balance of probabilities that seepage originated from defendants' flat 6E because multiple independent and properly conducted Fluorescent Dye Tests over several years were negative and the competing EMM and MLD evidence was inconclusive or liable to false positives; therefore the action fails and must be dismissed.
