Leave to appeal was refused because the abuse of process argument was not reasonably arguable and the trial judge's factual findings — that the VCDs bore hallmarks of infringement and that the purported authorisations were bogus — were amply supported by the evidence such that any procedural error over s65C admissions did not establish a substantial and grave injustice warranting leave.
