There was cogent and compelling evidence of fraud and a frozen account holding substantially the plaintiff's funds; the disclosure sought was specific, proportionate and likely to materially assist the plaintiff to identify wrongdoers and preserve assets, therefore a Norwich Pharmacal order should be granted; conversely a gagging order was refused because it is an exceptional remedy not justified where the account is frozen, the passage of time reduced risk of interference and the plaintiff had not shown a strong case for secrecy.
