Although the appeal was arguable, the judge was not persuaded there was a real likelihood the Court of Appeal would reduce the sentence to five years or less such that the appellant would have served more than any substituted sentence before the appeal was heard; given that risk and the hardship of recall to a young appellant, bail was unjustified and was refused.
