The Tribunal found the grant was not a 'resite house grant' because it was not given in exchange for specific rural land (it was a welfare allocation in the relocation context), the appellants failed to prove that the beneficial owners were indigenous villagers or their paternal lawful heirs throughout the relevant period, and the appellants had not become legal trustees of the registered title and therefore lacked statutory standing; accordingly the statutory exemption did not apply and the appeal was dismissed.
