The applicant's conviction was lawful because she committed the deception by preparing false application forms with the requisite mens rea and intended the co-defendant to sign them; she was therefore liable for her own acts executed through an innocent agent without need for a joint enterprise finding, and no unfairness arose from the judge acquitting the co-defendant but convicting her.
