The magistrate’s finding that the child was the natural child of Madam Ho was supported by evidence and, on a proper interpretation of s.34(2)(a), the child was within the class in need of care and protection given the mother’s background and the risk of moral danger; accordingly custody should be returned to the mother subject to recognisance and supervision; the appeal is dismissed.
