The display of infringing discs in the shop amounted only to an invitation to treat and did not constitute an "offer for sale" under the ordinary law; because the charge specifically alleged "offering for sale" the prosecutor could not, at the appellate stage, rely on the unpleaded alternative of "exposing for sale," and it would be unjust to amend the charge or uphold the conviction at this stage, therefore the conviction was quashed.
