The Court of Appeal held that the Chinese Temples Ordinance confers on CTC functions extending beyond mere control of funds to include oversight of proper management in appropriate circumstances and that CTC had a duty to take reasonable investigatory steps when serious issues about membership were raised; however the Chu J findings were inadmissible as new evidence between non-parties and substantive reliefs (declaration/mandamus) were refused as disproportionate or unnecessary, so the appeal was dismissed and no substantive relief granted.
