The challenged wording did not invalidate the warrants: the inclusion of 'seize and retain' in the s17 warrant was surplusage because the power to seize existed under s10C(1)(c) of the ICAC Ordinance; the phrase 'likely to be relevant' did not have a materially different effect in the circumstances given the supporting affirmation; accordingly the warrants were not void on their face and the applications to extend the interim sealing order and to stay the order pending appeal were refused.
