Chinese customary law applied; the deceased's family line became extinct on the widow's death and only daughters surviving that moment could inherit, therefore So Tai (predeceased) had no entitlement; the 2016 assignment conveyed only Yuk Tai's entitlement which equated to one half of the deceased's share and King Wong's claim to administration and distribution was valid in respect of that entitlement; the administratrix was ordered to furnish accounts and to administer and distribute the estate accordingly.

The Chinese Divorce Agreement was formally defective and did not dissolve the 1950 marriage; therefore Madam Young remained married to Mr Wang at her death; Madam Young was domiciled in Singapore at death so Singapore intestacy law applied; under that law the beneficiaries are Mr Wang's estate, the plaintiff and the defendant with the plaintiff entitled to the majority; accordingly letters of administration should be granted to the plaintiff (or his lawfully constituted attorney) and declarations made to that effect.

Where a pre‑IEO intestate died without issue, spouse or adopted successor and no competing claimants exist, the court will apply Qing Code Article 88(2) and relevant authorities to vest the estate in the nearest male agnatic next generation (here the nephew Wong Chiu); forfeiture to the State is exceptional and does not apply where a suitable agnatic relative exists, therefore the plaintiff as personal representative of Wong Chiu is entitled to the remaining 50% beneficial interest.

The court found on the balance of probabilities that the 1947 Chinese modern marriage between Fung senior and Mdm Lee was valid and that there was no satisfactory evidence that Fung senior and Mdm Chow were validly married in 1949; additionally Mdm Chow had made material misrepresentations in her affirmation and thus the 2008 grant was improperly obtained and must be revoked; as between the parties the plaintiff was the more appropriate person to administer the estate; the counterclaim was dismissed except insofar as an ancillary order concerning the legitimacy of Mdm Chow's children was made.
