The appeal is dismissed because the appellate court concluded the trial judge was not required to give an express warning about the dangers of visual identification when sitting alone, the identification evidence was properly assessed and found reliable despite the delay in arrest and the manner of the parade, and there was no improper use of the second appellant's silence; convictions were therefore safe and upheld.
