Although admission of the irrelevant answer about a prior raid was erroneous, the remaining evidence from police officers—who were not accomplices—was overwhelming such that no reasonable magistrate could have reached a different verdict; the omission to refer to corroboration was not fatal and the proviso applies to dismiss the appeal.

Conviction quashed because Crown failed to adduce evidence of regular or habitual use of the premises for gambling; the inspector's statement that an authorization had been obtained following observation was insufficient to prove habitual use; although the authorization was not produced, evidence showed it had been issued and that was not contradicted.

The magistrate wrongly excluded evidence of a prior occasion (5th September) which the Crown was entitled to adduce to prove habitual user; that exclusion prevented proof of an essential element and rendered the conviction unsafe, therefore the appeal is allowed and a retrial ordered before a differently constituted court.
