There was no high degree of foreseeability of burglary on the facts: Kevin Tower had an extensive security system and no history of prior break-ins, nothing put the defendant on special alert and there was no evidence the attendants completely failed in their duties or how the thief entered; accordingly CLP did not breach a duty in a way that caused the loss and is not liable for the independent criminal act.
