The court adjourned the petition to sanction the Scheme sine die because the Stock Exchange had determined to cancel the listing and the Company intended to seek review by the Listing Review Committee; permitting the sanction hearing to proceed would risk wasted judicial resources and potentially influence the regulatory review. Separately, the court had jurisdiction to amend the order appointing provisional liquidators to reflect payment arrangements and to sanction the debt settlement agreement addressing release of security and treatment of unsecured debt.
