The defendant's own pleaded case that the Operating Licence and the transfer agreement were illegal meant the court would not assist in recovering monies paid under those illegal arrangements; accordingly the defendant's application for judgment on admission was dismissed.

Finger-pressing treatment as performed on the police officer is within the ordinary meaning of 'massage' or falls within 'other similar treatment' in s.2 of the Miscellaneous Licences Ordinance (Cap.114), and an acupuncturist is not within the statutory exceptions (not a duly registered medical practitioner); therefore such treatment carried out on premises requires a licence under s.4 Cap.114.

The magistrate's findings that the premises were used for reception of persons requiring massage brought the premises within the statutory definition of "Massage Establishment" under s.4 of the Miscellaneous Licences Ordinance; therefore the conduct and aiding and abetting convictions were lawful and the appeals were dismissed.
