The plaintiff is entitled to all costs of his carried interest claim because the defendants' defence based on 'Cause' under the ALPA was legally misconceived; however the plaintiff is not entitled to indemnity costs under Article 4.3 of the ALPA because the Court found he solicited a breach of the My Show covenant, and indemnity costs in the court's discretion are unjustified because the defendants' conduct was not outside normal litigation conduct.
