The Court held the sentencing judge erred in adopting the top of the tariff starting point for the second count given the mid-range quantity and mitigating circumstances (coercion, financial pressure, clear record, guilty plea); applying a lower starting point and the appropriate discount produced a total concurrent sentence of 11 years, and the appeal was allowed to that extent.
