The court found there is a serious question to be tried that the Defendant was subject to enforceable confidentiality obligations under the NDA and Letter of Agreement, that the information is confidential and liable to cause irreparable harm if published, that Hong Kong has jurisdiction and is the appropriate forum, and that the balance of convenience favors continuing the injunction; accordingly the interim injunction is continued and the Defendant's procedural challenges and discovery/strike out applications are dismissed.
