The Master held that the challenged portions of the witness statement and the interrogatories (save Interrogatory 5 which was withdrawn by plaintiff) are relevant to the pleaded issues, necessary for preparation and not scandalous or oppressive; the defendants failed to establish a prima facie case that additional undisclosed audio recordings exist; accordingly all three summonses were dismissed (withdrawal application dismissed except for Interrogatory 5), and defendants were ordered to pay the plaintiff's costs (including costs of the Re‑fixing Application).
