Service of the notice of originating motion at the address for service recorded under the Trade Marks Rules was valid service on the proprietor; alternatively, where the proprietor has had adequate notice, the originating motion may proceed without further formal service outside the jurisdiction. The order below setting aside service was therefore set aside and the matter remitted to the Court of First Instance.
