The appellant was guilty of professional misconduct because, having attended a promotional event and been photographed administering injections, she failed to take adequate proactive steps to prevent the use or appearance of her name,title and photographs in material promoting Restylane and Botox; a written undertaking by the employer was insufficient to negate the duty to prevent third party promotional use and the Council's factual findings and penalty were open on the evidence and law.
