    No satisfactory evidence established a valid marriage between the deceased and the defendant as defined by IEO s.3; the documents relied on by defendant were insufficient and an affirmation by a third party not tested orally was given no weight; plaintiff was proven to be the natural son of the deceased by his evidence, birth certificate, the deceased's visa application and the defendant's earlier acceptance; accordingly plaintiff is entitled to letters of administration.

    On the balance of probabilities the documentary evidence (Malaysian birth certificate, Malaysian identity card, marriage certificate, English birth certificate of defendant's son and Australian passport) together with corroborating correspondence and photographs established that Susan Cook is the deceased's daughter born as Chong Poh Yoke; accordingly Susan is entitled to share in administration and distribution of the estate and letters of administration should be granted jointly to Susan and Sally.
