On the pleaded facts the court was satisfied that the elements of a common intention constructive trust were established and that there was a genuine need to grant declaratory relief despite the defendant's default; further, because the trustee/registered owner is out of the jurisdiction or cannot be found it was expedient to make a vesting order under the Trustee Ordinance to give effect to the declaration and enable the executrix to deal with the Property.
