On true construction of the Implementation Rules Schedule 5 the prosecution must prove that the organisation in fact satisfied the Schd 5 s1 definition of foreign agent and that the appellants were office-bearers or managers of such an agent; defendants may challenge the validity of a Schedule 5 notice in criminal proceedings; the prosecution's redaction of the only material relied upon to establish foreign agent status both prevented proof of an essential element and deprived appellants of a fair trial, so convictions quashed.

The failure by the prosecution to disclose material that was potentially relevant to the credibility of key accomplice witnesses breached the prosecution's disclosure duty and rendered the conviction unsafe; accordingly the appeal must be allowed, the conviction quashed, and a retrial on a fresh indictment ordered, subject to prosecutorial remedies and appropriate disclosure procedures prior to retrial.

Late disclosure by the prosecution, while deplorable, did not in the circumstances render the trial unfair because defence counsel were able to cross-examine on the late material, no application to stay or for further time was pursued below, and the judge properly evaluated the principal witness's credibility on the whole of the evidence; convictions are therefore upheld and sentences are appropriate save for a limited reduction to D1's consecutive term to reflect exceptional circumstances.
