A 1.5 month delay without any good or valid reason, combined with the failure to identify any viable ground of appeal and the absence of any real prospect of success, justified refusal of an extension of time; lack of legal representation does not excuse the delay or create entitlement to relief.

The court concluded paragraph 10(i) of the defence, as originally worded, was grammatically and substantively incapable of being an admission of the plaintiffs' asserted fact; therefore there was no valid admission to withdraw and no real prospect of success on appeal, warranting dismissal of the plaintiffs' application.

The court accepted that counsel for the 1st Defendant had sufficiently shown there may be some prospect of success on appeal on the pleading point concerning paragraph 12A of the Reply and therefore proposed to accede to the application for an interim stay of execution, subject to hearing the parties on the terms of the order.
