The provisional costs order had become absolute due to no timely application to vary it; the court therefore conducted a summary assessment and, having regard to reasonableness and the absence of any response from the plaintiff, reduced the claimed amounts to HK$15,000 (Department of Justice) and HK$20,000 (Y&C) and ordered immediate payment.

Because the plaintiff did not respond to the costs claims, the four matters shared the same factual background and the hearing was very short, the Court made a summary assessment: Department of Justice awarded HK$15,000 per case and Y&C (and parties represented by Y&C) awarded HK$20,000 per case; those amounts are to be paid by the plaintiff immediately.

Because the defendant neither applied to vary the provisional costs order within 14 days nor filed any opposition to the plaintiff's written costs statement, the Court summarily assessed and ordered the defendant to pay the plaintiff's costs in respect of the subpoenas dated 1 February and 27 March 2024 in the sum of HKD 42,000.

Respondent's application to vary the provisional costs order is dismissed because the respondent failed to demonstrate special circumstances to depart from the ordinary rule that costs follow the event; the applicant succeeded on liability and partly on remedies and the unsuccessful sub‑claims were not discrete events that would justify reducing the applicant's costs entitlement.
