The ordinary rule that costs follow the event applies; public funding does not justify departure; the respondent's simplified assessment of HK$32,549 is not unreasonable given the work categories and the applicant's repetitive filings increased costs; therefore the applicant must pay the respondent HK$32,549 in respect of the appeal costs.

Leave to appeal was refused because the appellant failed to show the appeal raised issues of significant and widespread or public importance under s.22, failed to identify any arguable error in the Courts below, and the proposed appeal concerned only his personal bankruptcy and pension entitlements; costs were awarded to the respondents in the amount fixed by the court.

Uncontradicted affidavit evidence of substantial encumbrances and absence of financial disclosure created a real probability that the judgment sum would be irrecoverable if paid; therefore the court properly exercised its discretion under R.S.C. O.59 r.13 to grant a stay of execution of the principal and interest, with the usual undertakings for payment of costs contingent on the result of the appeal.
