An agreement by an incoming public officer to accept substantial payments in return for being or remaining favourably disposed towards private interests is an agreement to commit misconduct in public office once the officer assumes the position; pre-office payments intended to secure an ongoing inclination that compromises independence can ground a conspiracy to commit misconduct in public office and it is not necessary to identify a specific act or omission to be performed once in office.
