Leave to apply for judicial review was granted because there were arguable grounds that the Director's exercise of discretion under the Immigration Ordinance in requiring the Applicants to report for redetention was unlawful; the court found the Director's discretion to release on recognizance under s36(1) only arose if removal orders under s13E(1) existed or became valid, and there were arguable issues about the validity and timing of those s13E orders warranting a full hearing.
