The Court of Appeal held the detention had become unreasonable and unlawful: respondents failed to justify continued detention after a prolonged period (about 1,208 days) because detention reviews were largely rote/tick-box and lacked contemporary, convincing risk assessments and explicit balancing against the long period already served; adjournments sought by the applicant did not, absent evidence of abuse or hopelessness, justify discounting the detention period; there was insufficient clarity or proximity as to when removal could realistically occur; release on recognizance was ordered.
