Applying the general rule, the plaintiff failed to demonstrate that the withdrawal was for reasons other than acknowledgement of defeat or likely defeat; the subsequent supplemental disclosures and affirmations were limited and did not render the application unnecessary, and the plaintiff's evidence lacked adequate particularity as to relevance and necessity; therefore the plaintiff must pay the defendants' costs of the summons and of the hearing.
