The Court held that the Tribunal's findings that price sensitive information existed and that the appellants' conduct (telephone records, trading anomalies, payments and failure to give credible explanations) supported inferences of tipping and insider dealing were sustainable and not open to disturbance on appeal; accordingly Sonny Chan's appeal was struck out as an appeal on fact, while limited leave to appeal was granted to Koon only on specified factual grounds (paragraphs 8,10,11,12 and 13 of his grounds).
