The late appeal was refused because no application for leave was made and no acceptable explanation for delay was provided; moreover the appeal had no real prospect of success because the Registrar's costs order was reasonable given the applicant's deliberate non-attendance, therefore the appeal is dismissed and costs ordered against the applicant.

Because the application had been dismissed on the applicant's own application and the dismissal order had been sealed, the court had no jurisdiction to restore or reinstate the proceedings; accordingly the reinstatement application was dismissed.

The Court awarded costs of this Court and the Court of Appeal to the appellants and declined to adjudicate on costs incurred in the Lands Tribunal, holding those costs should be determined by the Lands Tribunal when the appellants' compensation claim is restored; the order nisi for costs is made absolute.

The summons to restore proceedings was misconceived because the plaintiff already held the three postdated cheques and could not, by enforcement, be put in a better position than possession of those cheques; consequently there was no basis to accede to the application, and although the defendant was late in delivering the first cheque by two days, the appropriate order was dismissal of the summons with no order as to costs.
