The plaintiff's claims are struck out because they are substantively the same matters already dismissed in prior proceedings brought by the co‑owner (Madam Leung) and therefore constitute an abuse of process and are barred by res judicata; accordingly RAOs and RPOs were granted to restrain further vexatious litigation by the plaintiff and costs were ordered on an indemnity basis for the actions that were abusive.
