    The Defendant, having been aware of and having elected not to oppose the Plaintiff’s mortgage enforcement proceedings, is estopped by her conduct from asserting a proprietary interest that would defeat the Plaintiff’s prior second mortgage; ancillary relief under the matrimonial regime cannot create a proprietary interest ranking ahead of an existing encumbrance; accordingly the registration of the Defendant’s Form A is to be vacated under s.19 LRO as other good cause shown and to prevent prejudice to the Plaintiff.
