The plaintiff failed to prove that the descriptive/geographical term 'Oriental Logistics' had acquired a secondary meaning distinctive of the plaintiff by the relevant date (March 2004); there was no evidence that the incidents of confusion were caused by any actionable misrepresentation by the defendant, and there was no evidence of actual or likely damage; accordingly the passing off claim failed and was dismissed.
