The trial magistrate's acceptance of the police witness' clear and consistent evidence over the appellant's contradictory account was justified; the discrepancies relied on by the appellant were either insubstantial or reasonably explained and did not render the trial unfair. Given the appellant's driving history and need for improvement, the fine and the order to attend a driving improvement course were appropriate; therefore both the conviction and sentence appeals are dismissed.
