Plaintiff failed to comply with O 19 r 8A by not serving a written notice of intention to enter judgment and evidencing service; therefore she was not entitled to enter default judgment and must pay the Defendant's costs of that application. The summary judgment costs are in the cause because the Plaintiff informed the Defendant of her change of position before the reply deadline (26 September 2023). Fifty percent of the costs of the written submissions are payable to the Defendant with a certificate for counsel. No costs order for the 23 November 2023 summons.
