On the facts the plaintiff was not under a special disadvantage that impaired judgment at the time of sale, the defendant did not know of any imminent hospitalisation or suicidal plan when agreeing the transaction, the defendant had no prior access to accounts and there were innocent explanations for the low price given the nature and risks of the small trading business; therefore the three Lo Wo elements were not satisfied and the transaction was not set aside. Claim dismissed.
